A Catholic order of friars that have taken vows of poverty is involved in a $1 million legal dispute over a woman’s bequest in her will.
The woman had left a house in North Fitzroy worth $1 million to the Order of the Capuchin Franciscan Fathers and its church in Hawthorn, leaving only $20,000 to each adult child. Neither of her grandsons, one of whom suffers from autism, developmental delay and hydrocephalus were beneficiaries of the will.
The woman’s children, Mrs Kolandt and Giacomo Muto, have launched a Supreme Court action against the religious order, claiming that their mother did not make “adequate provision” for them in her will.
