The former executives and directors of James Hardie will find out today whether they have successfully appealed a previous ruling that they breached the corporations law.

A judge previously found the former executives and directors to have approved a press release in 2001, which said an asbestos fund was “fully funded” even though it was underfunded by more than $1 billion.

The NSW Supreme Court of Appeal will make its decision today, following an appeal by 9 of the 10 executives and directors who are seeking to overturn the fines and banning orders that were imposed.
