On 4 January 2013, in a media release on the Ministers website for Innovation, Industry, Science Research and Tertiary Education, the Minister for Small Business, Brendan O’Connor announced a review of the operation of the Franchising Code of Conduct.

In summary, the review will focus on all aspects of the Franchising Code of Conduct with particular attention on the amendments made in 2008 and 2010 to ensure that they are operating effectively.

The review will also consider:

  • Questions of good faith in franchising;
  • The rights of franchisees at the end of their franchise agreements including recognition for any contribution they have made to building the franchise; and
  • The operation of the Competition and the Consumer Act 2010 with respect to enforcing the code.

The final day for submissions from stakeholders in the franchising industry is 15 February 2013.
